1. Agreement to These Terms
These Terms of Use ("Terms") govern your access to and use of OnByte.com and related services (the "Service"), operated as OnByte ("OnByte," "we," "us," or "our"). By creating an account, joining the waitlist, or otherwise using the Service, you agree to these Terms.
If you do not agree to these Terms, do not use the Service.
2. About the Service and Current Availability
OnByte is currently in an invite-only beta. Access is limited to users who join through the waitlist, an early-access or promotional code, or a Household invitation. We may change how access to OnByte is granted at any time.
OnByte is currently a family learning platform offering games such as SpellSprint, SpellFill, and Pattern Discovery, along with progress tracking, achievements, leaderboards, and Groups.
3. Eligibility and Accounts
Adult accounts. You must be at least 18 years old to create and hold your own OnByte account.
Managed-child profiles. Children use OnByte only through a managed-child profile created and managed through an adult's OnByte account within a Household. A child does not independently create an OnByte account. The adult creating a managed-child profile is responsible for confirming that they are the child's parent or legal guardian, or otherwise have appropriate authority to create and manage the profile on the child's behalf, and by creating the profile, acknowledges our Children's Privacy Notice.
Adult responsibility. Adults are responsible for the activity that occurs under managed-child profiles they create and for managing the settings available to them, such as leaderboard participation and (for managed children age 13 and older) Group-creation permissions.
Account security. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly at support@onbyte.com if you believe your account has been accessed without authorization.
4. Usernames and Public Identity
Your username and avatar, and any username and avatar you set for a managed child, may be visible to other users in certain contexts, such as leaderboards, Family boards, and Groups. We encourage choosing a username and avatar that do not reveal a child's real-world identity or other personal information; however, OnByte does not guarantee that a username is anonymous or fully free of identifying information.
You agree that a username you set, including for a managed child, will not:
- Contain another person's real name, address, phone number, email address, school name, or other identifying information about a child
- Be obscene, hateful, threatening, sexually explicit, or otherwise inappropriate
- Impersonate another person or OnByte staff
- Attempt to evade our username or content rules
OnByte may reject, change, or remove a username that violates these Terms. We do not guarantee that every violation will be automatically detected, and we may rely on user reports and periodic review in addition to any automated checks.
5. Acceptable Use and Community Conduct
OnByte's competitive and social features are limited to Household features (such as Family leaderboards), Groups, and Global Leaderboards. OnByte does not currently offer chat, direct messaging, or public posting. When using these features, you agree not to:
- Harass, bully, threaten, or demean any other user
- Post or use hateful, discriminatory, obscene, or sexually explicit content, including in usernames
- Impersonate another person, account, or OnByte staff
- Attempt to manipulate, cheat, or interfere with the fair operation of leaderboards, leagues, or Groups
- Misuse invitations, early-access codes, or the waitlist, including by sharing access in a way not permitted by us
- Attempt to gain unauthorized access to another user's account or to any part of the Service not intended for you
- Interfere with, disrupt, or attempt to reverse engineer the Service
- Use automated means (such as bots or scrapers) to access the Service without our permission
We may investigate suspected violations and may suspend or terminate access as described in Section 11.
6. Household and Group Features
Household. Household features let an adult connect family members, create and manage managed-child profiles, and view a Family leaderboard among Household members.
Groups. Groups let you form or join communities outside your Household (for example, extended family, clubs, or teams) for shared leaderboards and invitations. Groups do not use Household seats. For managed-child profiles classified as 13 or older, an adult may control whether the profile can create new Groups; the profile may still be permitted to join existing Groups. Managed children classified as under 13 (based on birth year) cannot create, join, or participate in Groups on their own. Parent-managed Group membership for under-13 children is not currently available.
7. Leaderboards
OnByte includes Global Leaderboards (platform-wide weekly leagues), Family leaderboards (within a Household), and Group leaderboards (within a Group). Rankings are based on weekly experience points ("XP") earned through qualifying gameplay. Managed-child profiles with a known birth year may participate in Global Leaderboards by default, where a username, avatar, league tier, and weekly XP may be visible to other users as privacy-safe competitive standings; an adult may disable this participation in Household settings. If a managed-child profile does not have a usable birth year, the profile does not appear on Global Leaderboards. Global Leaderboards do not enable messaging, opening other players' profiles, following players, sending invitations, or other social interaction. OnByte does not currently offer tournaments or cash or physical prizes for leaderboard participation.
8. Educational Nature of the Service; No Guaranteed Outcomes
OnByte is designed to make learning engaging through games and interactive practice. OnByte is intended to support learning and practice, not to replace professional instruction, evaluation, or diagnosis. We do not guarantee any specific educational outcome, skill improvement, or result from using the Service.
9. Content and Intellectual Property
The Service, including its games, puzzles, curriculum content, design, graphics, and software, is owned by OnByte or its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial, family use.
You may not copy, modify, distribute, sell, or create derivative works from the Service except as expressly permitted by us.
10. Feedback
If you send us feedback, suggestions, or ideas about the Service, you agree that we may use that feedback to operate, maintain, and improve OnByte without any obligation or compensation to you.
11. Service Availability, Changes, and Beta Status
OnByte is currently offered as a beta and is provided on an "as is" and "as available" basis. Features, availability, and content may change, be added, or be removed at any time, including without prior notice, as we continue developing the Service. We may perform maintenance that temporarily limits access to the Service.
We may suspend or terminate your access to the Service, in whole or in part, if we reasonably believe you have violated these Terms, engaged in abusive or unsafe conduct, or for other operational or legal reasons. You may stop using the Service at any time. For questions about closing or removing an account or managed-child profile, contact support@onbyte.com or privacy@onbyte.com.
12. Pricing
OnByte is currently available at no charge. We may introduce paid features, subscriptions, or other paid offerings in the future. If we do, we will provide reasonable notice before any change that would require payment for functionality you are currently using at no cost.
13. Third-Party Services
The Service relies on third-party services to operate, including services that support account sign-in, hosting, data storage, analytics, and security. Your use of features that rely on these services may also be subject to the relevant provider's own terms. We are not responsible for the practices of third-party providers beyond our agreements with them.
14. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY EDUCATIONAL OUTCOME WILL RESULT FROM USE OF THE SERVICE.
15. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ONBYTE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, GOODWILL, OR PROGRESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ONBYTE FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
16. Governing Law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
17. Changes to These Terms
We may update these Terms from time to time. We will update the "Last Updated" date above when we do. If we make material changes, we will provide reasonable notice, such as posting a notice on OnByte.com, and, where required by law or appropriate given the nature of the changes, we may ask you to affirmatively accept the updated Terms before continuing to use the Service. Otherwise, your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
